Vertige, LLC (“Vertige”, “we” or “us) respects your privacy and is committed to protecting it through our compliance with this policy. This privacy policy (“Privacy Policy”) describes the types of information we may collect from you or that you may provide when you download and use the Vertige App (“App”) and our practices for collecting, using, maintaining, protecting and disclosing that information.
This Privacy Policy applies to all registered users of the App (“Users”, “user,” or “you”). Before using the App, please read the Privacy Policy carefully. By using the App, you agree to the terms of this Privacy Policy. We encourage you to read the Privacy Policy, and to use the information it contains to help you make informed decisions. This Privacy Policy may change from time to time (see How We Will Notify You of Changes to this Privacy Policy).
How We Will Notify you of Changes to this Privacy Policy
This Privacy Policy is effective as of the date stated at the top of this Privacy Policy. We may change this Privacy Policy from time to time. We may notify you of any such changes by sending a notice by e-mail, by placing a prominent notice on the App, or by other means. By accessing the App after we make any such changes to this Privacy Policy, you are deemed to have accepted those changes. Please refer back to this Privacy Policy on a regular basis.
Information that We Collect or Receive
In the course of operating the App, we collect and/or receive certain information you enter on our App or give us in any other way. You authorize us to collect and/or receive such information. This includes:
Personal Information. We only receive or collect information that identifies you personally if you choose to provide such personally identifiable information. When signing up to become a user, you will be required to provide us with personal information about yourself. You may also provide such information through use of the App. This includes:
Contact information that personally identifies you such as your name and email address;
Demographic information, such as your gender and birth date;
General health information, which includes any information relating to your health status, history, diagnoses, and effect of your health conditions on your livelihood;
Participation in a clinical trial. Vertige is participating in a research study focusing on the impact of environmental factors on vestibular symptoms with medical institutions. This study is referred to as “Clinical Study”;
Vertigo episodes occurring after the App has been download that you choose to input, as well as related factors such as medication.
This information is referred to collectively as ‘Personal Information’. We do not collect any Personal Information from you when you use the App unless you provide it to us voluntarily.
Personal Information collected through the Clinical Study. We may obtain information that identifies you from the Clinical Study you consent to participate in. The rules applicable to the collection and use of that information are contained in:
The agreement between Vertige and the doctors in charge of the Clinical Study.
The informed consent that you have signed with the doctors when enrolling in the Clinical Study
Geolocational Information. Certain features and functionalities of the App are based on your location. In order to provide these features and functionalities while you are using your mobile device, we may, with your consent, automatically collect geolocational information from your mobile device or wireless carrier and/or certain third-party service providers (collectively, “Geolocational Information”). Collection of such Geolocational Information occurs only when the App is running on your device. You may decline to allow us to collect such Geolocational Information, in which case we will not be able to provide certain features or functionalities to you. In addition, if you disable or remove tracking technologies entirely, some parts of the App and its services may not function correctly. You can exercise choice over the location data collected through our App by disabling location in your device settings or disabling location permissions to that App.
Other Information. In addition to Personal Information and Geolocational Information, we may automatically collect or receive additional information regarding you and your use of the App and information regarding your computer and mobile devices used to access the App (collectively, the “Other Information”). Such Other Information may include:
From You. Additional information about yourself that you voluntarily provide to us such as nutrition, weather and other information.
From Your Activity. We may collect or receive information regarding:
IP address, which may consist of a static or dynamic IP address and will sometimes point to a specific identifiable computer or mobile device;
Date and time you accessed or used the App; and
Details regarding your activity on the App (including performance and usage data).
How Vertige Will Use the Personal Information
We collect such information only insofar as is necessary or appropriate to fulfill the purpose of your interaction with us.
By using the App, you authorize us to use the Personal Information, Geolocational Information, and the Other Information (collectively, the “Information”) to:
Administer your App account;
Provide you the services you have requested regarding the App;
Respond to your customer service requests regarding the App;
Solicit your feedback regarding the App;
Send periodic emails to you regarding new updates, marketing materials, discounts ;
Improve our App; and to
Personalize your experience while using the App.
In an ongoing effort to better understand our users, the App, and our products and services, we may analyze certain Information to operate, maintain, manage, and improve the App.
We may share and/or license the Information we collect or that you provide with our affiliates, agents, business and promotional partners, and other third parties. We may also disclose the Information to describe the App to current and prospective business partners and investors and to other third parties for other lawful purposes including to analyze and improve the App and promote our business.
As we develop our businesses, we might sell or buy businesses or assets. In the event of a corporate sale, merger, reorganization, sale of assets, dissolution, or similar event, the Information may be part of the transferred assets.
To the extent permitted by law, we may also disclose the Information:
when required by law, court order, or other government or law enforcement authority or regulatory agency; or
whenever we believe that disclosing such Information is necessary or advisable, for example, to protect the rights, property, or safety of us or others, including you.

We may sell, license or transfer to additional outside parties the Information that we collect or you provide. Additional outside parties with whom Vertige may share or sell Information may include:
The doctors running your clinical study
The Universities that approved the IRB for the clinical study
Other parties as may be contemplated in the IRB protocol for the clinical study
Choices About How We Use and Disclose Your Information

How You Can Access and Correct Your Information and Communication Preferences
We take reasonable steps to ensure that the information we collect is relevant for its intended use, accurate, and complete. You can access and update your contact information by visiting the Profile widget on the App. You can deactivate your account through the in-app application terminate option. We will send you an e-mail to confirm your request. Please note that deactivating your account only removes your user profile. Please also note that we may retain certain anonymized and nonanonymized information associated with your account in our archives, including for analytical purposes as well as for recordkeeping integrity.
You may also send us an email at info@vertige.app to request access to, correct, or delete any nonanonymized Personal Information that you have provided to us. We cannot delete your Personal Information except by also deleting your user account. We may not accommodate a request to change information if we believe the change would violate any law or legal requirement or cause the information to be incorrect.
We may also deliver notifications to your mobile device (e.g., push notifications). You can disable these notifications by deleting the relevant service or by changing the settings on your mobile device.
How Vertige Protects Your Information
We want you to feel confident about using the App, and we are committed to protecting the information we collect. We take commercially reasonable efforts to keep Personal Information secure in our files and systems.
Use of the App requires you to establish a User ID and password. You agree that you will be responsible for maintaining your password as confidential and for any activity that occurs on your account as a result of you sharing your password with another or failing to protect it. Vertige is not responsible for any loss or damage arising from your failure to maintain the confidentiality of your password.
Also, please understand that no security system is impenetrable. We cannot guarantee the security of our databases or the databases of the third parties with which we may share such Information, nor can we guarantee that the Information you supply will not be intercepted while being transmitted over the Internet. In particular, e-mail sent to us may not be secure, and you should therefore take special care in deciding what information you send to us via e-mail.
Children Under the Age of 13
This App is not intended for children under 13 years of age. No one under age 13 may provide any information to the App. We do not knowingly collect personal information from children under 13. If you are under 13, please do not use or provide any information to this App. If we learn we have collected or received personal information from a child under 13 without verification of parental consent, we will delete that information.
Using the App from outside the United States
If you are visiting the App from outside the United States, please be aware that your information, including Personal Information, may be transferred to, stored, and processed in the United States, which has data protection and other privacy laws that might not be as comprehensive as those in your country. By using the App, you understand that your information may be transferred to our facilities and those third parties with whom we share it as described in this Policy. Therefore, if you are located outside the United States and choose to use the App, you hereby irrevocably and unconditionally consent to such transfer, processing, and use in the United States and elsewhere. Nevertheless, please be assured that Vertige complies fully with U.S. privacy and data protection laws, as described in this Privacy Policy, to ensure that your privacy is protected.
App Stores
Your app store (e.g., the AppStore) may collect certain information in connection with your use of the App, such as Personal Information, Payment Information, Geolocational Information, and other usage-based data. We have no control over the collection of such information by a third-party app store, and any such collection or use will be subject to that third party’s applicable privacy policies.
